Terms of Service

Welcome to troimarket. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the platform.

1. Account Registration

To use certain features of troimarket, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

troimarket is for adults. You must be at least 18 years old to create an account, buy, sell, or otherwise use troimarket. You may register using an email address and password or through Google Sign-In; either way, by creating an account you confirm that you are at least 18. If we learn that an account belongs to someone under 18, we close it.

Assistants and connectors. You may connect an AI assistant or another app to your account through troimarket’s connector (troimarket.com/assistant). Anything it does on your account, such as publishing or editing a listing, posting a Creator note or changing your store, counts as done by you. You can disconnect it at any time on that page. It is never given your password, and it cannot see or move money.

2. The Marketplace

troimarket is a platform where users can buy and sell digital products. We facilitate transactions between buyers and sellers but are not a party to the transaction itself.

• Sellers can publish products (individually or as bundles) at prices they set, with a minimum of $1.00 for paid content. Free products are also permitted.
• Buyers can browse, discover, and purchase products. A purchased product remains accessible to the buyer for as long as troimarket operates — except where the payment is refunded, disputed, or reversed (see Section 4).
• Editing a listing. Sellers can change a listing's title, description, price, tags, cover and preview pages at any time. The file that buyers receive is never changed by an edit; to replace a file, the seller removes the listing and publishes it again. A price change applies only to future purchases. It never alters what an earlier buyer paid or received.
• Sellers may take a listing off sale at any time (see Section 8).

3. Content and Intellectual Property

You retain ownership of all content you create and publish on troimarket, including products, images, and descriptions. By publishing content, you grant troimarket a non-exclusive, worldwide license to display, distribute, and promote your content on the platform.

You represent and warrant that:

• You own or have the right to publish all content you submit
• Your content does not infringe on any third party's intellectual property rights
• Your content does not contain false, misleading, or harmful information
• Any images you upload are yours or you have permission to use them

You confirm this each time you publish a listing. Listings that break it are removed from sale, and each removal counts as a strike against your account. Repeat infringers, and single cases where the infringement is plain, lose their account: it is suspended and every listing of theirs comes off sale.

What buyers may do with a purchase. When you buy a product, or add a free one to your library, the seller grants you a personal, non-exclusive, non-transferable licence to download and use it. You may use it in your own work, including work you sell or are paid for: for example, using a template in a client project, printing objects from a 3D file, or using a prompt pack in your own projects. You may not resell, share, give away, publish or upload the product itself or a lightly changed copy of it, or include it in another product that is mainly the same thing. A seller may set stricter or more generous terms in a product's description; where they do, those terms apply to that product. Ownership of the product stays with the seller.

If you believe content on troimarket infringes your copyright, use the Report this listing link on the listing page, or send a notice to our designated agent as described in our DMCA & Copyright Policy: Copyright Agent, troimarket, PO Box 811282, Los Angeles, CA 90081, United States, dmca@troimarket.com, +1 (323) 510-8557. We review every report promptly.

4. Purchases and Payments

All payments are processed through Whop, our payment partner. troimarket never receives or stores your payment card details. By making a purchase, you agree to Whop's terms of service in addition to these Terms.

• Platform fee: troimarket charges sellers a 1% platform fee on each sale, deducted automatically at the time of payment. Whop's payment processing fees also apply under Whop's terms.
• Refunds: All sales are final by default; refund requests are reviewed case-by-case as described below. When a payment is refunded, disputed, or charged back, the buyer's access to the purchased content is revoked.
• Except as described above, purchased products remain accessible even if the seller takes them down or deletes their account.
• Payouts: Sellers receive payouts through Whop according to Whop's payout schedule and terms. Receiving payouts requires completing Whop's identity verification, which is available only to adults (18+). Earnings from sales are held until verification and payout setup are complete.

Refund policy. All products on troimarket are digital goods delivered instantly upon purchase; accordingly, all sales are final and, by completing a purchase, you consent to immediate delivery. Buyers may submit a refund request from their library within fourteen (14) days of purchase. Requests are reviewed by troimarket on a case-by-case basis; refunds are issued at troimarket's sole discretion and are not guaranteed. Refunds may also be issued directly by the seller or may result from Whop's dispute and resolution process. If a refund is issued, funds are returned to the original payment method, access to the item is revoked, and the buyer and seller are notified by email. Sellers are responsible for refunds and chargebacks associated with their sales, per our payment provider's terms. Nothing in this section limits any rights you hold under applicable consumer protection law that cannot lawfully be waived.

5. User Conduct

You agree not to:

• Redistribute, resell, or share purchased product content outside the platform
• Create multiple accounts to circumvent restrictions
• Use the platform for any unlawful purpose
• Upload or post anything listed in Section 6 (Prohibited Content), or anything that violates any law
• Attempt to interfere with the platform's operation or security
• Scrape, crawl, or use automated means to access the platform
• Impersonate another person or entity

6. Prohibited Content

troimarket is for work you made and have the right to sell. You may not list, sell, give away or post any of the following, anywhere on troimarket: in products, bundles, covers, previews, descriptions, Creator notes, links or intro videos.

• Someone else's work. Pirated files, copied or lightly altered work, or anything that infringes a copyright, trademark or other right (see Section 3).
• Weapons. Files, plans or instructions for making or modifying firearms, firearm parts, suppressors, conversion devices, ammunition, explosives or other weapons. This includes 3D print files.
• Sexually explicit material. Pornography or other sexually explicit content. Any sexual content involving minors is reported to the authorities.
• Harmful software. Malware, spyware, hacking tools, exploits, or anything made to break into, take over or damage systems, accounts or data.
• Other people's private information. Personal data, passwords, account lists or private images of others, and content that harasses, threatens or exposes anyone.
• Illegal or dangerous content. Content that promotes or enables illegal activity, violence, terrorism, self-harm or eating disorders, or the sale of drugs or controlled substances; and anything that is illegal where you or your buyers live.
• Hateful content. Content that attacks or demeans people on the basis of race, ethnicity, national origin, religion, sex, sexual orientation, gender identity, disability or similar characteristics.
• Deceptive listings. Scams, fake or misleading products, counterfeit goods, get-rich-quick schemes, and anything that impersonates a person, a brand or troimarket.
• Dangerous health or money claims. Content that claims to cure or treat a medical condition, or that guarantees health, weight-loss or financial results.

We decide whether content breaks these rules. Content that does is taken off sale, and each removal counts as a strike as described in Section 3. We may suspend an account after a single serious case, and we may report illegal content to law enforcement. If you see something that breaks these rules, use the Report this listing link on the page.

7. Storefront and Profile

Sellers may set up a storefront with a unique name, bio, and social links. Storefront names must be unique across the platform. We reserve the right to require changes to storefront names that are misleading, offensive, or infringe on trademarks.

8. Taking Down Content

Sellers may take down their products or bundles at any time. Taken-down content:

• Will no longer appear in search or discovery
• Remains accessible to buyers who previously purchased it
• Can be restored by the seller at any time

9. Account Deletion

You may delete your account at any time through Settings. When you delete your account:

• Your profile and storefront will be removed
• Your published products will show "from deleted user" to buyers who purchased them
• Buyers retain access to products they purchased from you
• This action is permanent and cannot be undone

10. Disclaimer of Warranties

troimarket is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, secure, or error-free. We do not verify the accuracy, quality, or safety of products published by sellers.

Not professional advice. Products on troimarket, including fitness programs, recipes, and guides on health, money or law, are made by independent sellers and are for general information only. They are not medical, nutritional, fitness, legal, financial or other professional advice, and nothing on troimarket creates a professional relationship with you. Talk to a qualified professional before starting a diet or exercise program, especially if you have a health condition, are pregnant, or take medication. You follow any product at your own risk, and neither troimarket nor the seller is responsible for the results you get.

11. Limitation of Liability

To the maximum extent permitted by law, troimarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the platform.

12. Indemnification

If someone brings a claim against troimarket because of something you did on the platform, you will cover it. That means you agree to defend, indemnify and hold harmless troimarket and the people who run it from any claim, demand, loss, liability, damages and cost (including reasonable legal fees) that arises from: content you publish or sell, including any claim that it infringes someone's rights or breaks Section 6; your use of the platform; your breach of these Terms; or any dispute between you and a buyer or seller. We may take over the defence of any such claim, and you agree to cooperate with us if we do.

13. Suspension and Termination

We may suspend or close your account, remove or take off sale any content, and refuse any listing, at any time and without notice, if we reasonably believe you have broken these Terms, if a payment partner or law requires it, or to protect the platform or other users. Where it is practical we tell you why. If your account is suspended or closed, you may not open another one.

You can close your own account at any time (see Section 9). When an account closes for any reason, these things still happen: buyers keep access to products they bought from you; purchase and sales records are kept as described in our Privacy Policy; any earnings owed to you remain subject to Whop's terms, including holds for refunds and chargebacks; and Sections 3, 10, 11, 12, 17 and 18 continue to apply.

14. Taxes

Sellers are responsible for determining, reporting and paying any taxes that apply to their sales and earnings, including income tax, except to the extent our payment partner collects and remits a sales tax or VAT at checkout under its own terms. troimarket does not give tax advice and is not responsible for a seller's tax obligations.

15. Third-Party Services

Parts of the platform are provided by others: payments, identity verification and payouts by Whop; embedded videos by YouTube; sign-in by Google if you choose it. Their terms and privacy policies apply to your use of those services, and we are not responsible for them. A seller's links to other sites are the seller's; we do not control or endorse what is behind them.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

If you have a problem with troimarket, tell us first at support@troimarket.com and give us thirty (30) days to try to resolve it with you. Any dispute that is not resolved that way will be brought only in the state or federal courts located in California, and you and troimarket each consent to the personal jurisdiction of those courts. If you are a consumer in a country whose law gives you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away.

18. General

• Entire agreement. These Terms, together with our Privacy Policy and DMCA & Copyright Policy, are the whole agreement between you and troimarket about the platform, and replace any earlier terms.
• Severability. If a court finds any part of these Terms unenforceable, that part is changed to the minimum extent needed, and the rest stays in force.
• No waiver. If we do not enforce a part of these Terms at some point, we can still enforce it later.
• Assignment. You may not transfer your account or these Terms to anyone else. We may transfer our rights and obligations under these Terms to a successor that takes over the platform; we will post a notice if that happens.
• Notices. We may send you notices by email to the address on your account or by posting them on the platform.
